"What's New with the Affordable Care Act?"

Wednesday, October 18, 2017 Stacy Barrow, Partner at MBWL in Boston and expert in Employee Benefits and Executive Compensation, shared his up-to-the-minute information and analysis of the state of Obamacare, the "state of the states" and several pending cases. With new proposals coming from the Senate overnight, Stacy shared a real-time perspective on where we're going in the health care debate. On the state of Obamacare FAR members reviewed the role of states in regulating the exchanges and providing access to the uninsured; the actions of the current administration to identify ineligible applicants and to reduce access by having weekly maintenance of the website and cutting funds for advertising; and the likelihood of changes as the result of the 2018 election cycle. He's watching closely the bipartisan efforts of Lamar Alexander and Patty Murphy, long term members of the Health Care Committee. Among the states' efforts, Stacy warns about arbitrary and capricious terms of coverage. He's watching which states are having experience with single payer programs and predicts that private insurance is better at controlling fraud. Among the cases he cited were ERISA on electronic distribution notifications, the Department of Labor's audits on wellness programs, and the application of Title VII re the interpretation of "sex" rather than "sexual orientation."
